Welcome to Webtrack Solutions. These Terms of Service ("Terms") govern your access to and use of our website (https://webtracksolutions.in) and our IT design, development, maintenance, and marketing services. By engaging us, visiting our site, or participating in our referral program, you agree to be bound by these Terms.

1. Services & Project Scope

Webtrack Solutions provides custom software engineering services including website design, website development, mobile application development, e-commerce systems development, SEO, and website maintenance.

• Project Proposal: The specific details, milestones, payment schedules, and features of each project will be outlined in a separate Statement of Work (SOW) or project agreement.
• Revisions & Iterations: We support feedback rounds during design wireframing. Revisions requested after the design is approved or during active coding phases may incur additional costs.
• Client Deliverables: Clients must provide necessary assets (content, images, logos, copy, server credentials) in a timely manner. Delays in supplying these assets will extend project completion timelines.

2. Free Online Tools & Calculators

Webtrack Solutions offers a variety of free online utility tools, financial calculators, developer converters, and SEO writing tools ("Tools"). By accessing these Tools, you agree to the following terms:

• As-Is Basis: The Tools are provided on an "as is" and "as available" basis. We do not warrant that the calculations, results, or data conversions are 100% accurate, complete, or reliable.
• Estimates Only: All calculations performed by our financial tools (including EMI, SIP, and Compound Interest calculators) are mathematical estimates for planning purposes only and should not be used as official financial, legal, or tax advice.
• Local Processing: Your inputs are processed locally in your browser and are not backed up, saved, or retained by us. We are not responsible for any data loss, tool failure, or incorrect calculations.

3. Refer & Earn Program

We offer a 10% commission on software development projects referred to Webtrack Solutions by our partners. Participation in this program is subject to the following rules:

• Registration: Referrers must submit their contact and UPI details, alongside their referred friend's contact information, through the offcanvas referral form.
• Qualifying Referrals: A referral only qualifies if the contact is a new client, signs an agreement with Webtrack Solutions, and completes payments.
• Payout Mechanism: Payouts are made directly to the referrer's registered UPI address. Commissions are calculated as 10% of the net project budget (excluding taxes, licensing, third-party plugin costs, or third-party hosting). Payouts are dispatched incrementally or in full only after Webtrack Solutions has successfully received equivalent milestone payments from the referred client.
• Abuse and Termination: We reserve the right to disqualify referrers and withhold commissions if we detect fraudulent activity, self-referrals, spamming, or other violations.

4. Intellectual Property Rights

Unless otherwise detailed in the project SOW, Webtrack Solutions transfers all intellectual property rights and codebase ownership of custom-built software, designs, and content to the client upon receipt of full and final payment. Until final payment is made, Webtrack Solutions retains complete ownership of all created source code, templates, databases, and custom assets. We retain the right to showcase the completed project in our public portfolio and case studies.

5. Payments & Billing

Payments must be made in accordance with the milestone schedule detailed in your project proposal. Invoices are due upon receipt or within the timeframe specified in the invoice. Late payments may result in suspension of ongoing design, development, maintenance, or hosting support services.

6. Limitation of Liability

To the maximum extent permitted by law, Webtrack Solutions, its freelancers, and partners will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, use, goodwill, or other intangible losses resulting from (i) your access to or use of our services or Tools, (ii) server downtimes or data losses, or (iii) any modifications made to the codebase by third parties after project handover.

7. Governing Law & Jurisdiction

These Terms of Service shall be governed by and construed in accordance with the laws of India. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts located in Mohali, Punjab, India.
